The toeslag reclaim letter (terugvorderingsbeschikkingrepayment decision · the official name of the 'you were overpaid, pay this amount back' letter) is one of the most common envelopes to land on a doormat in the Netherlands. We explained why it arrives in an earlier post: allowances are paid in advance based on an estimated income, and the real calculation follows later. This post is about what comes after the letter. You have 6 weeks from the date on the letter, and within those 6 weeks you need to choose one of three paths. Ignoring the letter is not a fourth option: if no payment or suitable arrangement is made within the period, Dienst Toeslagen can start offsetting the debt against other payments or begin the collection process.

Check what the letter actually says first

Do not pay before reading the decision. The letter contains:

  • Which allowance and which year. Zorgtoeslag 2024 and huurtoeslag 2025 are separate decisions; both can arrive in the same week.
  • The amount and how it was calculated. The advance you received, the amount you were actually entitled to in the final calculation, and the difference between them.
  • The payment deadline. 6 weeks from the date on the letter (dagtekeningthe date on the letter · the 6 week payment period is counted from this date).
  • The minimum monthly instalment. How much you have to pay at minimum each month under the standard plan; this figure is printed in the letter.

Look closely at the income figure used in the calculation. An income that is not yours, a wrong partner registration, or an address you never lived at can push the amount far above what it should be. If you spot an error like that, go straight to the objection section at the end of this post; the payment plan comes after that.

Path 1: pay in full within 6 weeks

If the amount is small and you have the money, this is the cheapest route. Debt paid within 6 weeks accrues no interest, no costs are added, and the file is closed. The payment details are in the letter; put the payment reference (kenmerk) from the letter in the payment description, otherwise the money can end up in the wrong file.

Path 2: the standard 24 month instalment plan, no application needed

If you cannot pay in one go, the only thing you need to do is deposit the first monthly amount printed in the letter before the 6 weeks are up. The standard plan starts automatically the moment that payment arrives; there is no form, no phone call and no confirmation letter to wait for.

The rules of the plan:

Rule Value
Maximum term 24 months
Minimum monthly amount 20 euro
First instalment At least 1/24th of the debt
Debt under 480 euro The term is shortened proportionally

Pay more and the plan ends sooner. Collection interest (invorderingsrentecollection interest · interest charged on the remaining debt once the 6 weeks have passed) accrues on the remaining debt during the instalment plan; the rate at the start of 2026 is 4.3 percent. The interest is requested separately at the end of the plan, so a small extra letter arrives after the last instalment.

If you miss one instalment, the arrangement can be put at risk, and Dienst Toeslagen can move to offsetting or the normal collection process. If you already know a month is coming when you cannot pay, apply for the personal plan instead of waiting.

Path 3: personal payment plan

If even the minimum monthly instalment makes it hard to get by, ask for a persoonlijke betalingsregelingpersonal payment plan · a plan calculated from your income, with a lower monthly amount. Dienst Toeslagen looks at your income, expenses, debts and assets; it calculates your payment capacity (betalingscapaciteitpayment capacity · what is left of net income once compulsory expenses are subtracted) and sets a lower monthly amount based on that.

Three things you need to know:

  1. Payment is paused while the application is reviewed. You are not asked to pay instalments while the request is being assessed. You get an acknowledgement within 10 working days and a decision letter within 8 weeks.
  2. The plan runs for 24 months, and the remaining debt is not pursued. If your capacity is not enough to clear the debt in 24 months, the remainder is no longer collected as long as you keep paying the plan on time. The one exception: a lump sum tax refund arriving within the following 3 years can be deducted from that remaining debt.
  3. If you have an asset that cannot easily be turned into cash, such as a house, the term can be extended to up to 72 months.

The application is made with the "Verzoek persoonlijke betalingsregelingpersonal payment plan · a plan calculated from your income, with a lower monthly amount toeslagen" form; it can be filled in online or downloaded and posted. Keep your income and expense documents ready; missing documents extend the 8 week period.

If you do nothing: offsetting, reminder, notice, execution

The 6 weeks pass and neither payment nor an application arrives, and it is Dienst Toeslagen's turn to act. The steps run in this order:

  1. The 6 weeks are up. Collection interest starts accruing on the remaining debt from this day.
  2. Is offsetting possible? If you still receive a toeslag, the debt can be deducted from that first.
  3. Betalingsherinneringpayment reminder · free first warning; comes before the formal notice. A free payment reminder.
  4. Aanmaningformal payment notice · adds costs; gives 14 days to pay. A formal notice, costs are added, 14 days to pay.
  5. Dwangbevelwrit of execution · the document that opens the route to seizure without a court order. Writ of execution, higher costs, 2 days.
  6. Beslag. Seizure of wages or a bank account.

Offsetting (verrekeningoffsetting · the debt being deducted from another amount that is owed to you). The debt can be deducted from a toeslag you still receive. Dienst Toeslagen first calculates your protected minimum income (beslagvrije voetprotected minimum income · the amount you must be left with even if a deduction is made); if not enough is left for your basic living costs, the deduction is reduced or not made at all. The debt from one allowance can be deducted from another, for example a zorgtoeslag debt from the kindgebonden budget. A tax refund can be offset as well.

Reminder, notice and execution. If there is no payment to offset, the normal collection chain runs, and every step from the aanmaningformal payment notice · adds costs; gives 14 days to pay onwards adds its own costs. We explained how the chain works in our post on debt letters.

Even at this point a personal plan can still be requested, and no payment is asked while the application is being reviewed. But once the aanmaningformal payment notice · adds costs; gives 14 days to pay cost has been added, it is not refunded.

If the calculation is wrong: object first, then arrange the plan

If the amount itself is wrong (income, partner, address, number of children), you have the right to bezwaarobjection within 6 weeks of the date on the letter. Objecting is free. The form depends on the type of decision you received: an objection to the terugvorderingsbeschikkingrepayment decision · the official name of the 'you were overpaid, pay this amount back' letter is usually sent in writing to Dienst Toeslagen, while the final calculation has a separate bezwaarobjection form. Your letter tells you which method applies to you; check it there.

Payment is usually postponed once you object. Dienst Toeslagen grants postponement of payment (uitstel van betalingpostponement of payment) in most cases while an objection filed within the deadline is being assessed. This may not apply if wrong information was given or a penalty is involved; check the conditions in your own letter. If the objection is rejected the payment period starts again, and the three paths above are open once more.

If you have several debts at once

If the toeslag debt is not your only debt (rent, health insurance, CJIB, tax) arranging a plan for each one separately quickly becomes unsustainable. The municipality's free debt assistance (schuldhulpverlening) negotiates with all your creditors at the same time, and Dienst Toeslagen pauses collection during that process. The earlier you apply, the more options you have.

What Letrin does with this letter

The problem with a reclaim letter is that two critical pieces of information sit in the middle of the page, buried in ordinary sentences: the payment deadline and the minimum monthly instalment. Letrin reads the photo and tells you in your own language: which allowance, which year, what the amount is, which day the 6 week period ends, and how much the first payment is for the standard plan.

As the deadline approaches it sets reminders: 7 days before, 2 days before and on the morning of the last day. If you want to request a personal plan or object, it prepares a formal Dutch draft with a translation beside it, so you know exactly what you are sending.
